He's already done his homework and back in that room he'd tried his best to read the scans for any sign of his hue, his Crime Coefficient, his mental state... He'd found nothing. How could they let him go without knowing, how could they be sure of what they were releasing? .... and if they'd done it for him, what other dangers might they have let loose into the world?
He doesn't answer right away, instead he busies himself by shifting where he stands, weighing out his options. He could save Kogami the worry, save himself the shame, and refuse... but if what Kogami says is accurate, then as soon as they meet in person he'll probably find out anyway.
